A federal appeals court has ordered a lower court judge to review claims of juror bias in the trial of Boston Marathon bomber Dzhokhar Tsarnaev.

He was convicted at trial of participating in the 2013 bombings with his brother and is sentenced to death.

The First Circuit Court of Appeals ruling yesterday was in relation to two jurors who lied on their questionnaires but were found to be unbiased by the judge.

The ruling orders the district court to investigate the reasons the jurors were dishonest but does not overturn his death sentence.

The Appeals Court is keeping in place the Death Penalty sentence. If there were issues with the jury than the Sentencing Phase would have to be repeated.
