Senator Ed Markey is asking the Government Accountability Office to weigh in whether the family separation policy at the southern border is a rule.
If it constitutes a rule, Markey says it's subject to a congressional vote of disapproval through the Congressional Review Act.
CRA resolutions of disapproval allow Congress to overturn regulatory actions at federal agencies with a simple majority vote.
Markey says the family separation policy is immoral and Congress should act to ban the practice.
No word on when lawmakers will decide that issue.
