Lawyers Want SCOTUS To Keep Bomber Out Of Death Chamber

Attorneys for the Boston Marathon bomber are asking the Supreme Court to keep prosecutors from pursing the death penalty against their client.

An appeals court vacated the death sentence of Dzhokhar Tsarnaev in July.

Prosecutors have asked the high court to review that decision.

The appeals court found the judge who oversaw the trial did not question potential jurors about their exposure to pretrial publicity in the case.

It also said Tsarnaev's attorneys were not allowed to present evidence in the case, such as his older brother allegedly murdering three people in 2011.
