The Massachusetts Supreme Judicial Court has issued a ruling that affects about 27-thousand OUI defendants in the commonwealth.
The ruling allows those who pleaded guilty or were convicted between June 1st, 2011 and April 18th, 2019 to have their pleas withdrawn or alternately request a new trial.
Joe Bernard, the Springfield attorney- instrumental in bringing the suit forward says that he is pleased with the decision but many lives were changed based on the flawed convictions that forced people to make life decisions.
The court based the decision on an investigation into the Massachusetts State Police Office of Alcohol Testing, which found that results from breathalyzers were flawed due to the machines being improperly calibrated.
