Governor Charlie Baker says the appeal of a judge's ruling on his ban of vaping product sales is about more than just preventing lung illness.
Baker says the larger question is on whether the governor has the authority to implement such a ban due to a public health emergency.
A judge ruled this week that Baker must properly refile the ban as an emergency regulation or it will be rescinded for nicotine vape products.
The judge has not yet ruled on marijuana vape products.
