Fast-food giant McDonald's is appealing to the Massachusetts Land Court after the Springfield City Council denied a special permit in January for a new restaurant.
The company was seeking to tear down a 40-year-old building on Allen Street and replace it with a new three-million-dollar store at the same spot.
Council members failed to reach the vote threshold for the permit after the Springfield neighborhood council called for limited hours at the drive-up window that the franchise owner did not agree to.
McDonald's called the permit decision "arbitrary" and "legally untenable" in its filing with the state.
