Breathalyzer tests are being banned, at least temporarily, in Massachusetts.
District Court Judge Robert Brennan has ruled that the tests, used to determine if a motorist is under the influence of alcohol, can't be used in court until major reforms are enacted at the state's Office of Alcohol Testing.
The reliability of the tests has been the subject of years of litigation, and it was recently discovered that the office intentionally withheld important evidence from defense attorneys.
Certain exceptions will be allowed, including for vehicular homicide cases.
Some police departments have warned that some arrests in drunk driving cases are videotaped and that evidence would still be admissible in court.
