A judge is throwing out one of the two murder charges against accused Blackstone mother Erika Murray.
The judge ruled yesterday that there is no proof that one of the two babies found dead in the home were found alive.
The defense is pursuing a mental health defense for Murray, who was found living in a filthy Blackstone home with four living children and three skeletal remains of infants.
The Prosecution rested its Case In Chief Tuesday.
The defense begins its case this morning.
