Gun Suit In Canada Will Move Forward

A Canadian judge is allowing a class-action lawsuit against Springfield-based Smith and Wesson to proceed. 

A stolen M-and-P 40-caliber handgun manufactured by Smith and Wesson was used in a mass shooting in Toronto in 2018. 

The suit says Smith and Wesson was negligent by not installing "smart gun technology" in the weapon to prevent it from being used by an unauthorized person. 

Smith and Wesson had sought to have the case in Ontario Superior Court dismissed.

The Company is not commenting.
