For a little more than a decade, district attorneys throughout the state had banned the use of breathalyzer test results because they were at best flawed and at worst were lacking credibility out of the Office of Alcohol Testing.
Defense Attorneys had expressed concerns for years.
They said juries often times used the results as a bright light as to what really happened during a drunk driving case.
DA Anthony Gulluni has reached a statewide agreement with defense attorneys and other DAs to rectify the standoff.
"This process of negotiation and cooperation resulted in a joint agreement between the state-wide team of representatives of the district attorneys’ offices and the plaintiffs.
The court adopted this joint agreement between all parties to ensure transparency and accountability from the Office of Alcohol Testing."
To ensure that there are no other issues -- an independent ombudsman will be employed to ensure reliability in future results.
