Karen Read is taking her double jeopardy argument to the federal courts.
Read has filed a lawsuit in federal court in Boston claiming jurors actually acquitted her at her recent trial over the death of her Boston cop boyfriend John O'Keefe in Canton.
Multiple jurors came forward after the judge declared a mistrial last July and told the defense that they all agreed she was not guilty of second degree murder and leaving the scene of a death.
The trial judge and the Supreme Judicial Court rejected the argument, saying if a verdict is not announced in court it cannot be imposed.
Meantime, the Judge during a motion hearing on Tuesday, ended the hearing early after word that two "independent" experts might have actually been paid by the defense without the knowledge of the prosecution or the court. Read Attorneys have rejected that claim.
